ABA Formal Opinion 512, issued in July 2024, addresses lawyers' ethical obligations when using generative AI. It requires lawyers to develop competence with AI tools under Model Rule 1.1, communicate with clients about AI use on their matters under Rule 1.4, and maintain confidentiality under Rule 1.6. It also covers supervisory duties for staff AI use and candor to tribunals. For PI firms, this means you need formal policies governing which tools staff can use, how client data is handled, and when clients must be informed about AI involvement in their case.
Not with a personal account. Consumer AI tools like ChatGPT's free tier have terms of service that explicitly state submissions are not confidential and may be used for training. In United States v. Heppner (SDNY, Feb. 2026), a federal court ruled that documents generated using a consumer AI tool without confidentiality protections were not protected by attorney-client privilege.
